Agreement to our legal terms

We are Protect Mayfield Heights (“Committee,” “we,” “us,” “our”), a ballot issue committee organized in Ohio, United States, at 6320 Woodhawk Drive, Mayfield Heights, OH 44124.

We operate the website www.keepmayfieldworking.com (the “Site”), along with any related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms form a binding agreement between you, whether personally or on behalf of an entity (“you”), and Protect Mayfield Heights, concerning your access to and use of the Services. By accessing the Services you confirm that you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree with all of these Legal Terms, you are prohibited from using the Services and must discontinue use immediately.

We will give notice of scheduled changes to the Services you use. Modified Legal Terms take effect when posted, or when we notify you at the email address you provided. Continuing to use the Services after that date means you accept the modified terms.

The Services are intended for people at least 13 years old, with parental consent required for anyone under 18. Voting on Issue 107 is separate from using this Site and is limited to registered electors of the City of Mayfield Heights under Ohio law.

1. Our services

The Services provide information about Issue 107, the ballot measure to restore U-7 executive office park zoning on the Parkland Blvd property in Mayfield Heights, allow residents to volunteer, and help neighbors stay informed ahead of the general election on Tuesday, November 3, 2026. The information provided is intended for lawful political activity and civic engagement.

The Services are not tailored to comply with industry-specific regulations beyond political campaign compliance requirements. You are responsible for compliance with the laws that apply to you.

2. Intellectual property rights

Our intellectual property

We are the owner or licensee of the intellectual property rights in our Services, including source code, databases, functionality, software, website design, audio, video, text, photographs, and graphics (collectively, the “Content”), together with the trademarks, service marks, and logos contained in them (the “Marks”). Our Content and Marks are protected by copyright and trademark law in the United States and elsewhere.

Your use of our services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or print portions of the Content for your personal, non-commercial use in support of the campaign to pass Issue 107.

Your submissions

By sending us any question, comment, suggestion, idea, or feedback about the Services (“Submissions”), you agree to assign to us the intellectual property rights in that Submission for use in furtherance of the Committee objectives.

3. User representations

By using the Services you represent and warrant that: (1) you have the legal capacity to agree to these Legal Terms; (2) you are at least 13 years old; (3) you will not access the Services through automated means without our permission; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use will not violate any applicable law or regulation.

4. Prohibited activities

You may not use the Services for any purpose other than legitimate political engagement. You agree not to:

  • Systematically retrieve data from the Services without our written permission
  • Trick, defraud, or mislead us or other users
  • Circumvent security-related features
  • Use information from the Services to harass, abuse, or harm another person
  • Submit false reports or misuse any support channel
  • Use the Services in a way inconsistent with applicable law
  • Upload or transmit viruses, malware, or other disruptive material
  • Engage in automated use of the Services without authorization
  • Impersonate another person or user
  • Use the Services for commercial purposes unrelated to the Committee
  • Interfere with or disrupt the Services

5. User generated contributions

When you create or make available any content through our Services (“Contributions”), you represent and warrant that:

  • Your Contributions do not infringe third-party rights
  • You hold the necessary licenses and permissions
  • Your Contributions are not false, inaccurate, or misleading
  • Your Contributions comply with applicable law
  • Your Contributions do not contain offensive, harassing, or threatening material
  • Your Contributions do not violate privacy rights or contain inappropriate material involving minors

6. Contribution license

By submitting content, you grant us the right to use that content for the Committee purposes. We do not claim ownership of your Contributions, but you grant us a license to use them in furtherance of our objectives.

7. Services management

We may monitor the Services, take legal action against anyone who misuses them, restrict access to or remove Contributions, and otherwise manage the Services to protect our rights and keep them working properly.

8. Privacy policy

Protect Mayfield Heights does not sell, rent, or share mobile opt-in information or consent with any third parties for marketing purposes.

How we collect information

We collect information you give us directly, through:

  • The volunteer sign-up form on this Site
  • Email you send us or subscribe to
  • Text message opt-ins
  • Conversations at meetings, events, and at the door
  • Contributions to the Committee, if and when we accept them

What we collect

The volunteer form on this Site asks for your first name, last name, email address, mobile number, street address, and the ways you are willing to help. Name and email are required; the rest are optional.

If the Committee accepts contributions in the future, we will also collect the contributor information Ohio campaign finance law requires us to record and report. We will update this policy before any online contribution processing begins.

Like most websites, our host records standard server logs, including IP addresses and browser information, for security and reliability.

How we use it

  • Contacting you about volunteering and about Issue 107
  • Coordinating yard signs, canvassing, events, and other help you offered
  • Letting neighbors know about election dates and voting deadlines
  • Meeting campaign finance recording and reporting obligations
  • Required political disclosures

We do not sell your information

We will never sell, rent, lease, or trade your personal information to third parties for commercial purposes. Your information is collected solely to support this initiative and related political activity.

When we share it

  • With regulatory authorities where campaign finance reporting requires it
  • With authorized Committee members and volunteers
  • With service providers bound by confidentiality obligations, such as our email, texting, and website platforms
  • With other political organizations or committees only with your explicit consent

We will never share your information with commercial entities for marketing unrelated to this initiative.

Security and retention

We use reasonable technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. We keep information for as long as the Committee is active and for any period required by law, and we dispose of it afterwards.

Your rights

You may ask us to:

  • Tell you what personal information we hold about you
  • Correct information that is wrong
  • Delete your information, subject to any legal retention requirement
  • Stop contacting you by email, text, or phone
  • Withdraw consent where consent is the basis for our use

9. Political communications compliance

Communications sent through our Services are intended to comply with applicable political communication law, including Ohio campaign finance law, the CAN-SPAM Act, and the Telephone Consumer Protection Act (TCPA).

Our political communications carry the “Paid for by” disclosure required by law.

10. Text messaging and 10DLC compliance

Protect Mayfield Heights sends recurring political text messages. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help.

Program description

By giving us your mobile number and opting in, you consent to receive political text messages from Protect Mayfield Heights. Messages may include:

  • Updates on Issue 107 and the campaign
  • Election reminders, including voter registration and early voting deadlines
  • Volunteer opportunities and shift reminders
  • Event invitations
  • Requests for support

Consent

  • Consent to receive texts is not a condition of volunteering or of any purchase
  • Message frequency varies
  • Standard message and data rates may apply
  • Carriers are not liable for delayed or undelivered messages

How to stop

Message content

All messages are political in nature and relate to this initiative. We do not send spam or commercial advertising.

11. Term and termination

These Legal Terms stay in effect while you use the Services. We may terminate access for any reason, including breach of these terms. Our messaging program ends after the general election on November 3, 2026, or when the Committee concludes its work on Issue 107.

12. Modifications and interruptions

We may modify or discontinue the Services at any time without notice. We are not liable for any modification or interruption.

13. Governing law

These Legal Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

14. Dispute resolution

Informal resolution. Before starting formal proceedings, both sides agree to attempt good-faith informal resolution for 30 days.

Binding arbitration. Disputes not resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association, conducted in Cuyahoga County, Ohio. Class actions are not permitted.

Exceptions. Intellectual property disputes and requests for injunctive relief are excluded from arbitration.

15. Disclaimer

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied. We make no warranty about the accuracy, completeness, or availability of the Content.

16. Limitation of liability

Our liability is limited to the maximum extent permitted by law. In no event will our liability exceed $100.00 USD for any claim.

17. Indemnification

You agree to defend and indemnify us against claims arising from your use of the Services, your breach of these terms, or your violation of third-party rights.

18. User data

You are responsible for the data you transmit to us. We perform routine backups but are not liable for data loss or corruption.

19. Electronic communications

You consent to receive communications from us electronically, and you agree that electronic records satisfy any legal requirement that a communication be in writing.

20. California users and residents

This Committee and its work are based entirely in Ohio. California residents may nonetheless contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210.

21. Miscellaneous

These Legal Terms are the entire agreement between us. If any provision is found unenforceable, the rest stays in effect. Nothing here creates a joint venture or partnership.
